Terms of Service

These Terms of Service ("Terms") govern your access to and use of Linkava's website, mobile app, and related services (together, the "Service"), operated by Linkava ("Linkava," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Linkava lets you create a personal profile page and QR code that links out to destinations you choose — such as social media profiles, contact details, websites, or payment pages. You are entirely responsible for choosing what content and links appear on your profile.

You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use of your account.

You retain ownership of the content and links you add to your profile ("Your Content"). By adding Your Content, you grant Linkava a worldwide, non-exclusive, royalty-free license to host, display, and distribute Your Content solely for the purpose of operating and providing the Service (for example, displaying your public profile page to visitors and encoding it in your QR code).

You agree that Your Content will not:

• Violate any applicable law, or infringe the intellectual property, privacy, or other rights of any third party;
• Link to malware, phishing pages, or content designed to deceive or defraud visitors;
• Contain content that is unlawful, harassing, defamatory, obscene, or otherwise objectionable; or
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We may remove content or suspend or terminate accounts that we reasonably believe violate these Terms, without prior notice.

Linkava is a tool that helps you organize and share links you choose. We do not create, review, verify, endorse, or control the destinations you or any other user link to, and we have no obligation to monitor them. Any link added to a Linkava profile — by you or by any other user — is added solely at that user's discretion and risk.

To the fullest extent permitted by law, Linkava disclaims all liability for the content, accuracy, legality, safety, or security of any third-party website, app, page, or destination that a user links to from their profile, including any loss, damage, or harm arising from a visitor following such a link. If you believe a link on the Service violates these Terms or the law, please report it to us at [email protected] and we will investigate.

You agree not to:

• Use the Service for any unlawful purpose;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems;
• Interfere with or disrupt the integrity or performance of the Service;
• Scrape, harvest, or misuse data from the Service or other users' profiles; or
• Use the Service to distribute spam, malware, or fraudulent content.

Some features of the Service require a paid subscription, Linkava Pro, offered as an auto-renewing monthly or annual plan. The subscription title, length, and price are shown in the app before you confirm any purchase, and prices may vary by region.

When you subscribe through the Apple App Store, the following terms apply:

• Payment is charged to your Apple Account at confirmation of purchase.
• Your subscription automatically renews at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription at any time in your Apple Account settings. Deleting the app does not cancel your subscription.
• Refunds for App Store purchases are handled by Apple in accordance with its policies; any unused portion of a free trial, if offered, is forfeited when you purchase a subscription.

Subscription plans and current pricing are also described on our Pricing page. Where you subscribe through a payment method other than the App Store, you authorize us (or our payment processor) to charge the applicable fees on a recurring basis until you cancel. Except as required by law or by the store through which you purchased, fees are non-refundable. We may change our prices with reasonable advance notice; continued use of a paid plan after a price change takes effect constitutes acceptance of the new price.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms, without liability to you, to the extent permitted by law.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR SAFETY OF ANY LINKED THIRD-PARTY CONTENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, LINKAVA AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY THIRD-PARTY LINK OR CONTENT ACCESSED THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $50.

You agree to indemnify and hold Linkava harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, the links you add to your profile, your violation of these Terms, or your violation of any law or third-party right.

We may update these Terms from time to time. We will post the updated version on this page with a revised "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the jurisdiction in which Linkava operates, without regard to conflict-of-law principles, except where local consumer protection law requires otherwise.
